Terms of Service

1. Who we are and how to reach us

These terms form a contract between you and Emma Visser, a sole trader trading as ProphetAI (“we”, “us”). Our address is 7 Oakdene Crescent, Marple, Stockport, SK6 6NZ, United Kingdom. Emma Visser is an individual trading in her own name; ProphetAI is not a limited company. To contact us, use emma.visser23@gmail.com or Whop support (Open your Whop account, choose ProphetAI and use Support). These are our channels for questions, cancellations, refunds, complaints and data requests. Payments are processed by Whop (whop.com), whose own terms apply to the payment.

By creating an account, starting a free trial, claiming Legacy access, joining our Discord server or otherwise using the Service you agree to these terms, our Privacy Policy, our Cancellation & Refund Policy and our Risk Disclaimer. If you do not agree, do not use the Service.

2. Who can use the Service

• You must be 18 or over (or the legal age for gambling-related content where you live, if higher). We do not knowingly serve anyone under 18.
• You must be able to form a binding contract and give us accurate account information.
• You are responsible for making sure that using betting information is lawful where you live. We do not provide the Service in any place where it would be unlawful.

3. What the Service is, and is not

The Service is an information and analysis service. It includes this website, the members-only ProphetAI Discord server, the Bet Builder, Deep Stats, Me vs the Machine (including its replay lab), data exports, and (on the API plan) a REST API (together, the “Service”).

• We are not a bookmaker and we do not take bets. We do not hold or handle your betting funds and we are not licensed to provide gambling facilities because we do not provide any.
• The track record is a simulation. ProphetAI's published results use a virtual bankroll. They do not account for real-world factors such as limits, restrictions, odds movement, slippage or liquidity.
• It is not advice. Picks, analysis and tools are general information. They are not regulated financial, investment or betting advice and are not a personal recommendation to you.
• There are no guarantees. Past performance, simulated or real, does not predict future results. You can lose money betting, including all of your stake.

You decide whether to place any bet, with whom, and for how much. You are solely responsible for those decisions.

4. Plans and prices

• Currency. Prices are charged in US dollars. Any figure shown in your own currency is an estimate based on recent exchange rates and is not the amount charged. Your card issuer may apply its own conversion fees.
• Tax. Prices are shown as the amount you pay. Where sales tax or VAT applies it is calculated and collected at checkout by Whop.
• Price changes. We may change prices. We will give you at least 30 days' notice by email or on your Whop account before a change affects an existing subscription, and you may cancel before it takes effect. Prices on the pricing page can change for new customers at any time.

5. Subscriptions, free trials and renewal

• Free trial. Paid plans start with a 7-day free trial. You must provide payment details to start it. If you do not cancel before the trial ends, your subscription starts and you will be charged the plan price. Your trial end date is shown in your Whop account, and we aim to remind you before the first charge. Cancel at any time before then and you pay nothing.
• Paying, and signing in afterwards. You can pay first. After payment you sign in with the Whop account you paid with, and your plan is unlocked on that account. Use the same Whop account each time; a plan belongs to the account that bought it.
• Payment methods. Whop offers cards and, where your device and browser support them, wallets such as Apple Pay and Google Pay. We never see your card or wallet details; they go to Whop and your payment provider.
• Automatic renewal. Subscriptions renew every month at the then-current price until you cancel. You authorise Whop to take each payment from your chosen payment method.
• Cancelling. You can cancel at any time from your Whop orders page or through Whop support. You keep access until the end of the period you have paid for. See the Cancellation & Refund Policy for the 14-day money-back guarantee and your statutory rights.
• Failed payments. If a payment fails we may suspend paid features until it is resolved. Your account and any Legacy access are unaffected.

6. Legacy access and the 28-day migration window

Before the paid launch the ProphetAI Discord server was open to everyone who joined. To say thank you, founding members (people who were members of the Discord server before the paid launch) may claim free Legacy access.

1. Go-live and window. We will announce a go-live date on the website and in the Discord server. From that date there is a 28-day migration window. The closing date is shown on the website and in the Discord server for the whole window.
2. How to claim. Sign in with Whop, link your Discord account and claim Legacy on the Legacy page, or subscribe to a paid plan. Either one counts as converting.
3. What happens when the window closes. Our Discord bot will remove from the server any member who has neither claimed Legacy nor holds an active paid plan, and will stop granting them access to member-only channels. You can rejoin at any time by subscribing. We will warn members by Discord message and in the server before the deadline.
4. Human review. Removal is carried out by an automated process based on membership status. If you think it was wrong, contact us (section 1) and a person will review it and restore access if you were entitled to it.
5. Legacy is free and has conditions. Legacy access is provided without charge. It covers the features listed in section 4, is personal to you, and depends on you following these terms. We may change or end Legacy access for everyone, or for a group of members, on at least 30 days' notice. We may end it immediately for serious breach of these terms. As it is free, no refund is due.
6. Subscribing later. Legacy members can upgrade to a paid plan at any time. Cancelling a paid plan does not remove Legacy access you are entitled to.

7. Your account and acceptable use

• Keep your login details and API keys secure. You are responsible for activity under your account. Tell us promptly if you think it has been compromised.
• Your account is for you. Do not share access, resell or republish picks, exports or API data, or run a competing service using our data.
• Do not scrape, overload, probe or attack the Service, circumvent access controls or rate limits, or reverse engineer it except where the law allows.
• AI assistants. You may use an AI assistant to read the website, build slips in the Bet Builder and analyse our data for your own use, within the published rate limits and robots rules. You remain responsible for what an agent does under your login. Do not use agents to gather data at scale for resale.
• Follow the Discord server rules and Discord's own terms. We may moderate or remove content and members who break them.

8. AI features and third-party services

The Bet Builder can create a prompt that you copy into an AI assistant of your choice (for example ChatGPT, Claude or Gemini). We do not operate those assistants, do not control their answers and are not responsible for them. Their output can be wrong. What you paste into a third-party assistant is governed by that provider's terms and privacy policy; do not include personal data you do not want to share. The Service also relies on third parties including Whop, Discord, Vercel and Upstash.

9. Intellectual property

We own the Service, our picks, analysis, branding, software and content (or have the right to use them). We grant you a personal, non-exclusive, non-transferable licence to use the Service for your own purposes while your access is active. You keep ownership of the bets and notes you enter; you give us permission to store and process them to provide the Service to you.

Software and downloads. The Service is a hosted website and Discord server; you do not install any ProphetAI software, so there is no separate end-user licence agreement. The licence above is the only licence we grant. Any file we offer for download, such as the API Postman collection, may be used and edited for your own use of the Service but not republished or resold. If we ever release installable software it will come with its own licence terms before you can use it.

10. Your rights as a consumer

If you are a consumer, nothing in these terms affects your statutory rights, including under the Consumer Rights Act 2015. Digital content and services must be as described, of satisfactory quality and fit for their intended purpose, and services must be performed with reasonable care and skill. If something is wrong, contact us. Your right to cancel is explained in the Cancellation & Refund Policy.

11. Our responsibility to you

• We are responsible for losses that are a foreseeable result of our breaking these terms or of our negligence. A loss is foreseeable if it was an obvious consequence of our breach or if you and we both knew it might happen when you started using the Service.
• Betting outcomes. The Service is information only. To the extent the law allows, we are not responsible for money you win or lose by betting, or for any decision you make using our content, our tools or an AI assistant's output. This does not affect our duty to perform the Service with reasonable care and skill.
• We are not responsible for losses that were not foreseeable, for business losses (we sell to consumers for personal use), or for events outside our reasonable control such as data-provider outages, bookmaker odds changes, internet failures or third-party service disruption.
• Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else the law does not allow us to limit or exclude, and nothing affects your statutory consumer rights (section 10).
• The Service is provided as available. We do not promise it will be uninterrupted or error-free, but we will take reasonable care to keep it running and accurate.

12. Suspension and ending the contract

We may suspend or end your access if you seriously or repeatedly break these terms, if you use the Service unlawfully, or if we are required to by law. We will tell you why unless the law prevents us. If we end a paid plan for a reason other than your breach, we will refund the unused part of the period you paid for. You can stop using the Service at any time and cancel as set out in section 5.

13. Changes to the Service and to these terms

We may improve or change the Service. If we make a change that materially reduces what a paid plan includes, we will give you at least 30 days' notice and you may cancel and receive a refund for any period you have paid for after the change takes effect. We may update these terms for legal, security or operational reasons or to reflect changes to the Service. We will notify you of material changes by email, on the website or in Discord, and the version date at the top shows what applies. If you do not accept a change, you may cancel before it takes effect.

14. Privacy

We process personal data as described in our Privacy Policy.

15. Complaints and disputes

Please contact us through emma.visser23@gmail.com or Whop support (Open your Whop account, choose ProphetAI and use Support), or write to Emma Visser, 7 Oakdene Crescent, Marple, Stockport, SK6 6NZ, United Kingdom first. We aim to reply within 5 working days and to resolve complaints within 28 days. We are not currently committed to using an alternative dispute resolution scheme, but you remain free to use any you wish. Citizens Advice runs a consumer helpline on 0808 223 1133 (England and Wales) and you can seek advice from your local Trading Standards.

16. General

• Notices. We may contact you at the email address on your Whop account or by Discord message. You may contact us by email, through Whop support or by post to the address in section 1.
• Entire agreement. These terms and the documents they refer to are the whole agreement between us about the Service.
• If part is unenforceable the rest still applies. If we delay in enforcing a right, we do not lose it.
• Transfer. We may transfer our rights and obligations to another business if it does not reduce your rights. You may not transfer yours without our consent.
• Third parties. No one other than you and us has a right to enforce these terms under the Contracts (Rights of Third Parties) Act 1999.
• Governing law. These terms and any dispute about them are governed by the law of England and Wales. If you live in England and Wales, the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland you may bring proceedings in either your local courts or the courts of England and Wales, and you keep the mandatory consumer protections of where you live.
